Definitions

The terms used have the following definitions:

  1. The Site: refers to the Internet site accessible at the URL address of this policy;
  2. The Publisher: refers to the organisation responsible for the Site, as defined in the Legal Notice accessible on the Site;
  3. Visitor: refers to any person browsing and using the Site;
  4. ‘General Terms and Conditions of Use’ and ‘GTCU’: terms designating these Terms and Conditions of Use, including the Personal Data Protection Policy accessible on the Site.

Article 1. Subject

These General Terms and Conditions of Use (hereinafter referred to as the ‘GTCU’) set out the rules for accessing and using the Site's services, as well as the rights and responsibilities applicable to all Visitors to the Site. The GCU are freely accessible and consultable by any person browsing/using the Site.

The Data Protection Policy, which can be consulted on the Site, forms an integral part of the General Terms and Conditions of Use and must be accepted expressly and without reservation by Visitors/Supporters if they wish to continue to browse and use the Site.

The GCU must be accepted unreservedly and in their entirety by any person wishing to access, browse and use the Site. They constitute the contract between the Publisher and any Visitor to the Site.

Visitors are advised to print out a copy of the GTCU and to consult them regularly.

Article 2. Description of the services provided

The purpose of the Site is to :

  1. to provide information concerning all of the Publisher's activities;
  2. to enable Visitors to keep abreast of the Publisher's activities;
  3. to enable Visitors to provide their information to the Publisher for the purposes of organising the Publisher's activities (events, field mobilisation, etc.), where these functions are activated on the Website;

Article 3. Access to the service

The Site is normally accessible to users at all times. However, the Publisher may decide to interrupt the service for technical maintenance purposes, in which case it will endeavour to inform users of the dates and times of the intervention in advance.

To access the Site, the Visitor must have personal computer equipment free of any virus, Trojan horse, logic bomb, computer worm or any other undesirable programme likely to disrupt the operation and use of the Site and/or browsing on the Site.

The Visitor undertakes to regularly update his equipment, hardware and software and connections necessary for the normal operation of the Site.

Article 4. Limitations of liability

The Publisher endeavours to provide information on the Site that is as accurate as possible. However, it may not be held liable for any omissions, inaccuracies or failures to update the information, whether caused by itself or by third-party partners who provide the information.

All information provided on the Site is given for information purposes only and is subject to change. Furthermore, the information on the Website is not exhaustive. It is given subject to modifications having been made since it was put online.

Article 5. Contractual limitations on technical data

The Publisher and the Publication Director cannot be held responsible for any direct or indirect damage caused to the user's equipment when accessing the Site. Any form of guarantee is therefore excluded in the event of damage.

Insofar as interactive areas may be made available to users, the publication manager reserves the right to delete, without prior notice, any content posted in this area that contravenes the legislation applicable in France, in particular the provisions relating to data protection. Where applicable, the publication manager also reserves the right to hold the user civilly and/or criminally liable, particularly in the event of messages of a racist, insulting, defamatory or pornographic nature, whatever the medium used (text, photographs, etc.).

Article 6. Intellectual property and counterfeiting

The Publisher is the owner of the intellectual property rights or holds the rights of use on all the elements accessible on the site.

Any reproduction, representation, modification, publication or adaptation of all or part of the elements of the site, whatever the means or process used, is prohibited without the prior written authorisation of the Publication Director.

Any unauthorised use of the site or of any of the elements it contains will be considered as constituting an infringement and will be prosecuted in accordance with the provisions of articles L.335-2 et seq. of the French Intellectual Property Code.

Article 7. Nullity

If one or more clauses of these GCU are declared null and void or invalid in application of a law, regulation or following a final decision by a competent court, the other articles/clauses will retain all their force and scope.

Article 8. Modification of the GCU

The Publisher reserves the right to make any changes and corrections/evolutions to these GCU. The new GCU will cancel and replace all previous General Terms and Conditions of Use.

Article 9. Duration

The GCU apply from the first connection to the Site and during its use. The duration of these GTCU is indefinite.

Article 10. Applicable law

These GCU are governed by French law. Only the French version will be deemed authentic. Any translations of these GCU are provided for convenience only.

Any dispute arising from the use of the Site, or from the application and interpretation of these General Terms and Conditions of Use or from the support of the Tribune, its consequences, and its aftermath are subject to French law and to the jurisdiction of the French courts.
